Terms of Service
These terms are an agreement between you and valaciel Pty Ltd ("we", "us") about your use of the Gloam app. By using Gloam you accept them.
What Gloam is
Gloam is a tool for recording and reviewing your own spending. It is not accounting, tax, or financial advice, and it is not a substitute for keeping the records your tax authority requires. Figures it produces come from data captured on your device and may contain recognition errors — you are responsible for checking anything you rely on.
Your account
You may use Gloam entirely on your device with no account. If you create one, you sign in through Google or Discord and are responsible for keeping access to that account secure. You must be old enough to form a binding contract where you live, and at least 13.
Your data is yours
You keep all rights to the receipts and information you put into Gloam. We claim no ownership of it and no licence to use it beyond operating the service for you. How we handle it is described in the privacy policy.
Encryption, and what it costs you
Gloam offers an optional Private Vault, and shared Ponds are always end-to-end encrypted. This means the encryption key is derived from your passphrase and never sent to us.
If you lose that passphrase and your recovery code, the encrypted data cannot be recovered — not by you, and not by us. There is no back door and no reset. This is the point of the feature, but it is a real risk you accept when you enable it. Save your recovery code somewhere you will still have it in a year.
Subscriptions and payment
Some features require a paid subscription. All purchases are processed by Google Play — we never receive your payment details.
- Subscriptions renew automatically until cancelled, at the price shown in Google Play at the time of purchase.
- Manage or cancel your subscription in Google Play, not in Gloam. Cancelling stops future renewals; it does not retroactively refund the current period.
- Refunds are handled by Google Play under Google's refund policy, together with any rights you have under the Australian Consumer Law.
- If your subscription lapses, your data is not deleted. Paid features — including sharing — stop working until it is renewed.
Sharing a Pond requires an active subscription on both sides. If yours lapses you keep read access to Ponds you belong to but cannot add to them.
Acceptable use
You agree not to:
- use Gloam to break the law, or to store someone else's personal information without a right to;
- attempt to access another user's data, or probe or disrupt our systems;
- reverse-engineer the app except where the law expressly permits it;
- resell or redistribute the app or access to it.
Availability and changes
We aim to keep Gloam working but do not promise uninterrupted availability. We may change, suspend, or discontinue features. If we discontinue the service materially, we will give reasonable notice and you will be able to export your data first — export exists in the app precisely so you are never locked in.
Ending this agreement
You may stop using Gloam and delete your data at any time from Settings → Data. We may suspend or end your access if you materially breach these terms, or if we are required to by law.
Liability
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. If a guarantee applies and we fail to meet it, you have the rights the law gives you.
Subject to that, and to the extent the law allows: Gloam is provided as-is; we are not liable for indirect or consequential loss, lost profits, or lost or corrupted data; and our total liability is limited to the greater of the amount you paid us in the twelve months before the claim, or (where the law permits) resupplying the service.
Keep your own copies of anything that matters. The export feature is there for exactly this reason.
Changes to these terms
We may update these terms. If a change is material we will update the effective date and notify you in the app. Continuing to use Gloam after that means you accept the change.
Governing law
These terms are governed by the laws of {{STATE}}, Australia, and you and we submit to the non-exclusive jurisdiction of its courts.
